Welcome to Devendra Paper Agencies (“DPA”, “we”, “our”, “us”). By accessing or using our website or services, you agree to these Terms and Conditions. Please read them carefully before using our website.

1. Use of the Website

• Our website provides information about DPA's packaging, disposable and related business products and allows customers to browse products, make enquiries and place orders.
• You agree to use the website only for lawful purposes and not for any illegal, fraudulent or unauthorized activity.
• Our website is for customers buying packaging and disposable products, whether for a business or for personal use. You must be at least 18 years old to place an order.
• You agree not to misuse, interfere with, or attempt to gain unauthorized access to any part of our website or systems.

2. Account and Customer Information

• When you provide personal or business information, you agree that the information provided is accurate, complete and up to date.
• You are responsible for ensuring that your contact, billing and delivery information is correct.
• You are responsible for maintaining the confidentiality of your account information and for activities carried out through your account.
• DPA may contact you using the phone number, WhatsApp number, email address or other contact details provided by you for order-related communication and service updates.

3. Product Information

• Product names, descriptions, images, prices, specifications and availability are shown for information only, are provided as is, and are not a warranty.
• Product images may sometimes differ slightly from the actual product due to photography, screen settings, packaging changes or manufacturer/supplier variations.
• Product availability is subject to stock.
• Prices shown are exclusive of GST. GST is charged as applicable, and the rate varies by product.
• Amounts shown on the website before DPA confirms an order are estimates. Items shown as “Price on request” are priced by DPA, and the customer must approve the price before the order proceeds.
• Prices shown on the website are not final. Product prices may change at any time without prior notice. The price that applies to your order is the one confirmed by DPA and approved by you when the order is confirmed.
• DPA reserves the right to correct errors, update product information or modify product availability without prior notice.
• An order is not considered finally confirmed until the applicable order and delivery details have been reviewed and confirmed by DPA and the customer.

4. Orders, Delivery Charges and Payments

• Orders placed through the website are subject to product availability and confirmation by DPA.
• An order placed on the website is an offer. A contract is formed only when DPA confirms the order, and DPA may accept or reject any order wholly or in part.
• Delivery charges are not included in the product price, are not calculated on the website, and are borne by the customer.
• The order is processed for dispatch after DPA confirms it.
• Payment terms are Cash & Carry unless DPA has approved credit for your account. Where DPA approves credit, payment is due within 15 days from the date of delivery.
• Ownership of the goods passes to you only when DPA has received full payment.
• If DPA changes a price or quantity in your order, the change will be sent to you for confirmation. If you decline the change, the order will be cancelled.
• The website does not process online payments. Payment is arranged directly with DPA after the order is confirmed, through the payment methods and channels approved by DPA.
• DPA reserves the right to cancel or refuse an order where there is suspected fraud, incorrect information, product unavailability, pricing error or other legitimate reason.

5. Cancellation

• You may cancel an order yourself, with a reason, until delivery has started, as set out in the Cancellation Policy.
• Once an order is being processed for dispatch or has been dispatched, cancellation is not permitted.
• Once you have marked an order as paid, or DPA has recorded your payment, you cannot cancel it online. DPA decides whether to cancel it.
• DPA may cancel any order at any time.
• Customers are responsible for reviewing products, quantities and delivery details before confirming an order.

6. Returns and Refunds

• DPA accepts returns, replacements or refunds only in the cases set out in the Refund & Return Policy, for example damaged, defective or incorrect products reported within 24 hours of delivery, or where required by applicable law.
• Used or opened products, custom-printed or personalised products, and products bought during a sale or special-discount offer cannot be returned.
• Customers should review order details before confirming an order. In case of an issue, contact DPA through the official contact details on the website.

7. Intellectual Property

• All content available on the DPA website, including the DPA name and logo, product images, photographs, text, graphics, designs, layouts and other materials, is owned by or licensed to DPA or its brand partners and is protected under applicable intellectual-property laws.
• You may not copy, reproduce, modify, distribute, publish, sell or commercially use any part of the website or its content without prior written permission from DPA.
• The DPA name, logo and branding may not be used without authorization. Third-party brand names, logos and product images belong to their respective owners.

8. Limitation of Liability

• DPA does not guarantee that the website will always be uninterrupted, error-free or available.
• DPA will not be responsible for losses or delays caused by circumstances beyond its reasonable control, including strikes, logistics delays, courier or supplier failure, government action, technical failures, natural events or other external circumstances.
• Customers are responsible for ensuring that products ordered are suitable for their intended use.
• To the extent permitted by law, all implied warranties and conditions are excluded.
• To the extent permitted by law, DPA's total liability for any claim relating to an order is limited to the price of the affected goods, and DPA is not liable for indirect, consequential or loss-of-profit damage.
• You indemnify DPA against losses arising from your breach of these Terms or your misuse of the products or the website.
• Nothing in these Terms is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.

9. Privacy

• Your use of the website is also governed by DPA's Privacy Policy.

• By using the website, you acknowledge that your information may be processed as described in the Privacy Policy.

• If any part of these Terms is held unenforceable, the rest continues to apply. DPA's failure to enforce a right is not a waiver of it. These Terms are the entire agreement between you and DPA about the website and orders. You may not assign your rights or obligations under them.
